Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your use of cmdsend's email services, operated by BigRadar Inc. By using our services, you agree to comply with this Policy and all applicable laws and regulations.

1. Prohibited Content and Activities

You may not use cmdsend to send, store, or process content that:

  • Contains or promotes illegal activities, products, or services
  • Infringes on intellectual property rights or proprietary rights of others
  • Contains malware, viruses, or any harmful code
  • Is defamatory, obscene, abusive, invasive of privacy, or objectionable
  • Harasses or advocates harassment of another person or group
  • Exploits minors in any way
  • Depicts or promotes violence or threats of violence
  • Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age

2. Email-Specific Requirements

2.1 Spam and Unsolicited Email

You may not use cmdsend to:

  • Send unsolicited bulk emails (spam)
  • Send emails without prior consent from recipients
  • Purchase, rent, or use third-party email lists
  • Harvest email addresses from websites or other sources without permission
  • Send emails to recipients who have opted out or unsubscribed

2.2 Required Email Components

All emails sent through cmdsend must include:

  • A valid "From" address that accurately identifies the sender
  • A truthful, non-deceptive subject line
  • A clear and conspicuous unsubscribe mechanism (for marketing emails)
  • Identification that the message is an advertisement (if applicable)

2.3 Sender Authentication

You must properly configure and maintain:

  • SPF (Sender Policy Framework) records
  • DKIM (DomainKeys Identified Mail) signatures
  • DMARC (Domain-based Message Authentication, Reporting, and Conformance) policies
  • Valid DNS records for all sending domains

3. Delivery Quality Requirements

3.1 Bounce and Complaint Handling

  • Maintain bounce rates below 5%
  • Maintain complaint rates below 0.1%
  • Immediately remove bounced addresses from your mailing lists
  • Honor all unsubscribe requests within 48 hours
  • Implement proper handling of hard bounces and soft bounces

3.2 Sending Practices

  • Do not send to email addresses obtained through scraping or harvesting
  • Do not use misleading or false header information
  • Do not forge email headers or falsify sender information
  • Do not attempt to bypass spam filters or authentication mechanisms
  • Maintain proper list hygiene and regularly clean your email lists

3.3 Content Requirements

  • Do not send emails with deceptive or misleading subject lines
  • Ensure all links in emails are functional and safe
  • Do not include phishing content or fraudulent schemes
  • Do not send emails that could be classified as malicious or harmful
  • Comply with CAN-SPAM Act, GDPR, and other applicable regulations

4. Prohibited Use Cases

The following use cases are strictly prohibited:

  • Adult content, pornography, or sexually explicit material
  • Gambling-related communications (unless properly licensed)
  • Pharmaceutical products without proper licensing
  • Work-from-home, money-making opportunities, or investment schemes
  • Cryptocurrency schemes without proper disclosure
  • Phishing, spoofing, or any form of identity theft
  • Multi-level marketing or pyramid schemes

5. Rate Limits and Volume

You must adhere to the rate limits and monthly quotas specified in your service plan. Sudden large increases in sending volume may trigger automatic reviews to ensure compliance with this policy.

6. Monitoring and Enforcement

We reserve the right to:

  • Monitor compliance with this Policy
  • Investigate complaints or reports of Policy violations
  • Remove or disable access to content that violates this Policy
  • Suspend or terminate accounts that violate this Policy
  • Report violations to law enforcement authorities
  • Take any legal action necessary to enforce this Policy

7. Consequences of Violation

Violation of this Policy may result in:

  • Warning and required corrective action
  • Temporary suspension of service
  • Permanent termination of account
  • Forfeiture of prepaid fees
  • Legal action and pursuit of damages

8. Reporting Violations

If you become aware of any violation of this Policy, please report it immediately to team@cmdsend.com. We will investigate all reports promptly and take appropriate action.

9. Changes to This Policy

We may modify this Policy at any time. Changes will be effective immediately upon posting. Your continued use of cmdsend after changes are posted constitutes acceptance of the modified Policy.
